Ban Smoking on VME5 Balconies
An Owner-Initiated Petition
The Problem
Balconies at Villa Marina East V are classified as exclusive-use common areas — meaning they are owned by the Association but assigned for the exclusive use of individual unit owners. Under California Civil Code and the Association's own governing documents, the Board has the authority to regulate conduct in common areas, including exclusive-use areas such as balconies, patios, and parking spaces.
Smoking on balconies sends secondhand smoke directly into neighboring units. It is a documented health hazard, a nuisance, and a source of ongoing conflict among residents. It also creates fire risk and potential liability for the Association.
What We Are Asking
We are asking the Board of Directors to adopt a rule prohibiting smoking — including cigarettes, cigars, pipes, and cannabis — in all exclusive-use common areas, including balconies and patios.
This is not an extreme ask. It is consistent with California law, supported by health science, and already in place at many comparable HOA communities across the state.
